Before I comment on the card, I have to bring this up:

i think of it as a spell because it melds all creatures together into one, +|+ being the atk|hp basically seals the deal to me.

So having attack/defense with variables instead of having a spell symbol makes it a spell to you? Oh the irony.

Now, about the card itself. I love the interaction with many cards in the game, and I do think it's balanced as is, although +1 cost certainly wouldn't hurt any.

You think it should cost more? So it would be 4 |3 ? I think i'm opening a poll for that!

Does Mimic copy passive abilities as well?

Good question! At first i thought that passive abilities shouldn't be copied, because for some reasons i thought that a creature can only have 1, like active.
But now that you are saying it, i think that the more accurate the copy is, the better.
So, yes, i think i should copy passive ability as well. And i'm adding it in OP.

Yes 
More precisely:
You play the 1st , nothing happens.
You play the 2nd, the 1st copies the 2nd, which is a 0 | 0, so it's like nothing happened.
Then they both die.

Ooh, I LOVE this! Fun and simple mechanics. I guess it would be quite a gamble to use these in any kind of serious deck since your opponent can always reverse these back into a weakling.. but these may be good for OTK. Maybe too good. Fractal Shapeshifters then play Amethyst Dragon = GG

But it changes everytime a creature is played (even more times per turn!), because it retain its Mimic passive skill.  8)

About the card art, i drew it. It's a modified photo of my eye. You can find another (abandoned) card of mine that uses the same photo: Aspect of Infinity (http://elementscommunity.org/forum/index.php/topic,25142.msg343092#msg343092)

Back to the name issue, i don't know the policy for names either, but i think that as long i use generic words there shouldn't be problems. "Shapeshifter" is an english word, and it isn't a specific creature name, so i guess it could stay as it is.

Anyways I'm sure lawsuit threats from Wizards of the Coast are really something we don't need to worry about for something like this.  This would be a Zanz decision, I'd just leave it.
