This is not a bug. The creature that was mutated did not come into play that turn, so it's ability was usable. If you mutate a creature that has come into play that turn, its ability is not usable, same as any other permanent/creature.

When a creature is mutated, it first decides what creature it's going to be (forest scorpion), then it decides its attack/hp (whatever/whatever), then it decides the skill it has (devour, destroy, steal, scavenger, deja vu, even nothing). If a creature is mutated into, say, a pegasus, it's not guarenteed to get dive, but it might. It also might end up being a 0/8 with dive. It's just luck.

However, if you reverse time the mutated creature, the card you draw will be the actual version of the card, and will come into play as it would normally if it were in your deck. Useful if you mutate something into a nymph and would rather use the nymph's real ability.

The forest scorpions ability isn't passive as creatures retain passive skills, despite you not activating the skill it is still classed as an active skill where as devourers ability (devour) is a passive skill, if the ability appears under the card on the field it's active if it only appears on the infobox under passive skills then it's passive.
