BUT unfortunately auto ban could ban people that are just victims of the out of sync issues that make it seem like someones hacking.

Is PvP peer-to-peer or hosted on a server somewhere?  Since this game is free, I expect it's p2p, since servers cost money, but I don't know.  The only way to secure a game is to have it hosted on a secure server; you can't really secure p2p, since flash games can't really be locked to prevent someone altering them as they run (flash wasn't designed to be a secure or closed virtual machine).

Yes.
BUT they can be unbaned, keeping this way the pvp games will eventualy die to hakers.
And there are ways to ban only non legit players.
