OK i have a puzzle, a man and his wife are driving down a road when they find a gas station, the man exits his car and tells his wife not to open the doors and locks them, when he comes out his wife is dead and there is a new person in the car, the door was unopened.

No, it actually is both a suicide and a homicide.  He killed himself, but only because of something that someone else was doing to him at the time.
