upped Baholder or Beholder?

Beholder is copywrited (if thats the word) by Dungeons and dragons/ wizards of the coast. Its one of few creatures they created, so you cant use it :/
Well, I read through many times WotC's licesences (though it's hard for me to comprehend texts like these even in my own language), and actually they claim Beholder as 'Product Identity', just like Mind Flayer and a lots of other creatures (otyugh too I believe), which is already in elements and countless other fantasy games - most of them not based on D&D setting, like Heroes for example. I don't really know if it's prohibited or not but if there is someone who can clarify these things up a bit, it's more than welcome. But if it is, then probably a namechange should be neccesary.. ( )Even Coryn named his illustration 'Beholder', and it was not meant for any WotC publication.
Well I guess 3DO is going to be in trouble if they used Beholders in Heroes of Might and Magic III (http://www.heroesofmightandmagic.com/heroes3/creaturesdungeon.shtml).I doubt using Beholder is a problem at all.
