that would work.. do damage = to the HP of the worm to the creature played. would immaterial be immune?and would the mine still blow?

Immaterial should not be immune, since your opponent has already been warned. If they're too lazy to see the Mine Worm's ability, it's their problem.

just not sure how it would get around immaterial not being targetable.. or is it a field effect like an immortal devourer gets boosted by night fall kind of deal. just trying to cover all bases i can think of to help him out. 6 of these would be pretty handy. oty gets blown up upon eating it as well then from what it says. my guess is if the effect changes to how u stated it guolin then it will deal damage to the oty which is still pretty beneficial. a new cheap source of CC for earth im sure would be nice.

The creature takes damage as soon as it is played, so it works.

I agree but as I'm not an artist, I though than using it as a filler before it gets into the game was still "sort of OK".

There's some arguments for and against it, but as it stands; this is a piece of art that has been paid for, and thereby, using it in any way is a bad idea.
